[2007]. 客觀”台灣國”獨立之可行性：
三缺一(領土), 應是不可能; 述如下..

構成國家的要件有 : (1).政府, (2).人民, (3).領土;

(1). 政府(對台灣之治權),由《1952 中日和約》取得 :

[Article 2] : 日本對”台主權”及”中國利益”之拋棄！
(b) Japan renounced(拋棄) all right, title(所有權) and
claim to Formosa and the Pescadores...
[Article 10] : 認同”中華民國”對”台灣人”之”治權”！
..nationals of the Republic of China shall be deemed(視為)
to include all the inhabitants and former inhabitants of
Taiwan (Formosa) and Penghu (the Pescadores) and their
descendents who are of the Chinese nationality in
accordance with the laws and regulations which have been
or may hereafter be enforced(實施,執行) by the
Republic of China in Taiwan (Formosa)......

(2). 人民(民權) :
要獨立之”台灣人”,約佔台灣全民之30%.( < < 50%. )

(3). 領土(主權) : (Territorial Sovereignty)
”台獨人”, ROC, PROC & USA 都主張有 台灣領土主權.

a). "台獨人”主張台灣是”台灣人”的土地. (假如,從無戰爭.)
     "台灣國” 則不必經國際條約(法的位階)之依據以爭取！
    但,台灣和這世界卻經歷過....二次大戰..etc.
    故,"台灣國"是爭不到"台灣"的這塊土地;或許可爭到"海埔新生地.

b). ROC 主張台灣是 ROC 的土地.因 1943開羅宣言 & 台灣光復節..

c). PROC 主張台灣是 PROC 的土地.因 PROC 是 ROC 政權之延續. (UN 之慣例.)

d). USA 主張台灣是 USA 的土地. 因 World War II, 遠東區是他打贏的.

[Taiwan’s Position as a US Insular Area]：（美憲法尚未承認之國土.）
US president Harry Truman and General Douglas MacArthur
should have had the authority to transfer the territorial
sovereignty of Taiwan to the Chinese nationalists.
(But, did not.)..(美未將台灣領土主權交與 ROC.)
the ROC only has”effective territorial control(支配;管理)”(ROC 有對台治權) over
Taiwan, but does not hold Taiwan’s territorial sovereignty.(ROC 無對台主權)
That territorial sovereignty is held by the US Military
Government. (美擁有台灣領土主權.)
In summary, if Taiwan wants to be independent, it should
be talking to members of the US Congress.(台灣欲獨立,要問美國會)！

為維持國際和平,美國都沒有表態(亦無拋棄); 但,其各方政策都符合
”台灣領土 是 US Insular Area”.

故,”台獨”還是沒有領土主權！ 即使”台獨”克服了 ROC & PROC.;
那又如何克服 USA？ 要打一個 World War III！？
(或許,花錢去另外買個島嶼. c.f.：阿拉斯加, 夏威夷...etc.)

[土地法 之最高原則]： (現行法)

[註]：

經”公投獨立”之小國是 i.e.:立陶宛三小國,是沒有”領土”主權
(Territorial Sovereignty)之問題. 這是與台灣不同的地方！

所以 UN 退回「以台灣名義加入聯合國申請案」。
