還沒到紐約之前
我托已經在紐約唸書的學妹幫我留意房子
PO找房子的公告後
有各中國人就來找我學妹說要跟我分租
就一起看
這中間
因為我學妹有車 就載著她到處看
後來我學妹有事得離開NYS
就變成他自己找
後來他找到房子以後
跟我通過幾次e-mail
要我先匯錢給她

等我到了紐約
她讓我跟她簽了一個lease 是我跟她之間的agreement
沒讓我看那個房東跟她的約

住了一個月後
開始繳第二各月的房租
我才發現
原來房租不是對分
是她挑比較大的房間$450
我的房間比較小可是我卻要付500

跟她反應不合理
她一直說房子是她辛苦找的
約也是用它的名字跟房東簽的
她有權收我這麼多
她要租誰多少就多少

可是當初明明就說好是平分的
現在她說
不然他退我押金和下個月的租金 要我馬上搬出去

我ㄧ整個理虧
我說我只要求評分房租
她說我過分 佔他便宜 說我很厲害 很會算計
當初
誰叫我笨跟她簽那個lease
她說他沒有騙我 她有跟我講整個apartment房租事950
難道不會自己算嗎
但
我整個有上當的感覺
當初通信都說要平分share
剛到紐約時完全避開不提她自己房間收的錢
現在變成他是二房東

我沒有刻意要引戰
但
遇到這種情形 也算學到一次教訓
中國人真的都這樣嗎?
我認識及少數的特例
但比例上來看 中國人真的太誇張了
很黑心 還很理直氣壯
真不想這樣說她
但他說不定還覺得台灣人很拗

我找了屋主 因為他們也是非法轉租
她不想惹麻煩 說要我們自己處理
我找了國際學生處
他們說這是personal 他們沒辦法介入

我該找移民局還是在台協會嗎
台灣懂法律的朋友看了我笨笨簽下的lease說那不是合法的
因為並沒有權利義務雙載
只有寫我要盡的義務
基本上我可以告她詐欺

Agreement to Share Apartment

This agreement is being made in the State of New York, July 31st,2008
between Hong Zhu and Shinq-Huey Tsai

Hong Zhu agree to provide part usage of apartment at 5 Southside Ave, #8C
to Shinq-Huey Tsai from July 20 until the remainder of current lease which expires on December 31, 2008.

Shinq-Huey Tsai will pay first month’s(Aug1-Aug31) rent of $500 and one month deposit o f $500 at the commencement of this agreement. Shinq-huey Tsai will in addition will be paying $150 for the period of July 20 through July 31. Tsai, Shinq-huey will send postal money order payable to Hong Zhu of $500 monthly rent, to be received by the 26th of every month.

Late fees as follows are demanded by Windsor Court Apartments: $25 if rent received after the 5th of the month, $95 if received after the 10th of the month.
These fees would be due to Shinq-huey Tsai if she is late with paying rent.

Apartment will be empty upon possession by Hong Zhu and Shinq-huey Tsai.
Apartment includes stove, refrigerator, and two air conditioners.

Apartment includes heat, water and basic cable with rent. Hong Zhu and Shinq-huey Tsai will share electricity and internet service in half.

Any maintenance problems with the apartment may be reported directly to Windsor Court Apartment by Hong Zhu and Shinq-huey Tsai.

Shinq-huey Tsai agrees to abide by the conditions of the original lease from Windsor Court Apartment in regards to rules, upkeep, not pets, etc. Shinq-huey Tsai agrees that, if in any given month, she is unable to make full rent apartment, she will either make arrangements agreed upon by lease holders to comply with rents/fees due, or vacate the premises by the end of that month.

Shinq-huey Tsai must give 30 days notice to vacate in order to end sublease agreement. Upon inspection of apartment by lease holders to affirm that apartment is empty and with stove, refrigerator, and air conditions, and in good order, Hong Zhu will return $500 deposit to Shinq-huey Tsai.

今天回家她主動找我談了
她找個朋友坐在旁邊
她願意還我押金和九月份的租金
但
要我八月底準時搬出去
我跟她說

1.七月份沒住的部份她收我150元，要一起還
她說要扣掉我七月底的那兩天，一天15塊成嗎?
$:不行，要除以12，我只住兩天

2.還跟她說網路的機子我付了錢，折舊後算一半還我

3.電費也要照天數算，我只付31天
牠說我七月底就到了，月底那兩天要算，
我跟她說去波士頓我三天不在家，可以互抵
她本來說不行，後來嫌麻煩就自己認了那兩天的電費
接著，兩個中國笨蛋在算電費
7/20-8/31總共住了43天，她們除以43再乘以31除以2─→這是小錢要付的
但是小錢7/30才住進去

我說我要一份英文的協議
他們兩個中翻英翻很久

老實說
看她們在擬協議的時候我滿腦子壞念頭
我甚至還有邪惡的念頭─→我要讓你直接回中國
